"WA firm first to be charged under Spam Act

The first charges ever laid under the Spam Act have been brought against
an east Perth company in Western Australia, which is alleged to be a
global spammer.
The Australian Communications Authority (ACA) alleges the company sent
out at least 56 million unsolicited emails in the year after the Spam
Act came into place.
The legislation was introduced in April 2004 and makes sending
commercial unsolicited emails illegal.
The authority raided the company's Perth premises in April after members
of the public reported receiving unsolicited emails.
The company is listed by international anti-spam watchdog Spamhaus as
one of the world's top 200 spammers.
If the company is successfully prosecuted in the Federal Court, it can
be fined up to $220,000 for each day it has breached the Act.
It may also have to forfeit profits and compensate victims.
The company's managing director, Wayne Mansfield, denies there has been
any breach of the law and says he welcomes the opportunity to prove it
in court."
