OT: eHow Copyright Infringed Me

eHow article:

My picture is used in the article. I stumbled upon this today. It
was lifted from here:

http://www.garagewoodworks.com/Cherry_Table_C.php third photo down.

I left a comment at the bottom complaining about it but it has been
deleted. Lol.

I flagged the article for copyright infringement, lets see what
happens.

The picture shown in the article is actually link to your web site's
picture. Change the picture on your site to screw with the offending page.

It's only allowed under what's called "fair use". Non-profit
purposes. The author profits, so "fair use" is out the window.

It's fairly easy for a -smart- server to check the 'referrer' field in a
request, and do one thing if the referrer is the same site (i.e. 'yours') as
the object being requested, and do 'something different' if somebody has
embedded a direct link to an 'internal object' of yours in _their_ page
on a different site.

This stops direct linking _only_. Doesn't prevent copying the image out,
storing it elsewhere -- e.g. on =their= server -- and using it.

yes, I noticed that also. He should have known better. But, did it

Doesn't have to say it. It's copyright protected automatically when
published. It's US law. See: The Digital Millennium Copyright Act of
1998

Ok. Thanks. The guy at the shop said they were pre-tuned, but I
wouldn't know the difference ( I don't think anyway).

The student may not need to pay a fee for use of the image. But it is
still required for them to give credit for the image. But even
publishers sometimes use photos that they have not gotten permission
for. If they can show due diligence in trying to find the owner of the
image the owner can't sue them but only collect the fair fees for use
if noticed.

Follow up and don't let the a**hole get away with it. Several
years ago, I began to get emails from people telling me a creep in
WI was selling the plans to my Jake's Chair, despite it being
specifically prohibited. I wrote him and a friend spent the $20
to get a copy of "his" plans for me from the eBay site. All the
plans were was a poor quality copy of the drawings I had posted
for the chairs, coupled with a bad photograph of his own copies.
The ass&ole's reply was, "sue me or complain to eBay and I'll tie
you up in court forever." Fortunately, there were enough friends
around that they posted horrible comments about quality and
authenticity on eBay that he gave up, finally.

A citation under the photo as a photo credit would have been nice.
Most people will never click the photo, thus never see the url.

Hmm indeed. The only way I can see this working is if mod_rewrite looks
at the referrer header and ensures that it is the local site; so absent the
REFERER header being spoofed, it should work.

This will also preclude things like wget, which aren't allowed to specify the
REFERER header[*].

This kind of stuff really annoys me as well. All he had to do is send a
quick email asking if he could use the photo because he was writing an
article and it was a great example, looked perfect. etc. I do not mean to

There is no guarantee that that use _is_, in fact, exempt as fair use.

'Fair use' is a notoriously complicated subject, and one which the courts
have gone out of their way to _not_ clarify, for *many* years.

The copyright statutes specify some criteria to 'be considered' in determining
'fair use', but do not specify 'how much' consideration is to be given to
any particular point. This is just one of the reasons that copyright
infringement cases are so expensive to pursue in court.

for word, picture for picture, chart for chart, in India ... no amount

on Internet "domain name service", complete with charts, the

Yes he should have. I hope you have a registered copyright; i.e., one paid
and registered with the Library of Congress.

The difference between registered and unregistered copyrights is that you do
not need to prove damages with a registered one, only that an infringement
has occurred. That infringement alone carries hefty statutory penalties;
any actual damage beyond that amount can also be recovered. If
unregistered, one has to prove infringement *and* monetary damages.

do a google search for 'htaccess' and 'mod rewrite'.
(assuming her http server is running Apache...). htaccess is a file
lets you specify all sorts of directives to help sort out issues like
this.
One of the many things mod rewrite can do is let you specify files
(in this case, jpgs/gifs) that can only be accessed by the home server,
and can tell the server what to do when it is accessed remotely. (as
well as all sorts of other neat tricks).

For the OP (and anyone else who cares), here'e one way I do it
(obviously, you need to turn mod rewrite on in htaccess first...) where
DOMAIN would be your domain.

I gave the guy an opportunity to contact me, but he deleted my first
comment and did not contact me as I requested. I flagged the article
with eHow, but I migt also do as you suggested by contacting their

Hmm - Michael Straessle, the article's 50 year old author, has a BA in
professional writing from the University of Arkansas at Little Rock and
claims to work full-time as a writer, which means he's fully aware of US
copyright law.

Mr Straessle says he's a "Teacher and Children's Pastor at Victory
Fellowship". I wonder if the Victory Fellowship distinguishes itself
from others by acknowledging only 9 commandments...

I'd imagine that your attorney could get his contact information from
the Alumni Office at the Univ of Arkansas at Little Rock.

screen grab of that quick, before they change it.

There doesn't have to be a notice in the US. It is a given that anything
one does is copyrighted unless one explicitly _waives_ copyright.

My HTML ("web page") file contains the URL (symbolic internet address)
of the images to be displayed. When my server log indicates a level of
abuse that exceeds my comfort level, I change the image file name and
update the URL in the web page to point to the new name.

Normally, after that the server would report "file not found" (status
404) when someone presents a request for the old URL - but I created the
file you saw with a graphics editor and gave it the old name of the
image file, so that people would see that instead of the "broken link"
symbol.

It's a PIA to do because it takes up time I'd rather spend on other
things - and it clutters up my server with extra image files - so I've
only done it a few times.

I've been on the verge of writing a program to periodically go through
my entire web site and diddle the file names, but haven't felt that I
could take the time to do that without hurting other projects.

In your cPanel you may find that you can simply turn off remotely serving
image files. Then if there are some you do want to remotely serve put them
in a separate directory and allow remote serving for files in that
directory. Some will even allow you to customize how remote serving
requests are processed. You will have to check out the options offered by
your host, but you may be surprised.

If the work is copied in total, it's plagiarism (the penalty for which
is becoming VP). If it's excerpted or referenced, it generally comes
under "fair use". Of course fair use still requires an attribution.

I have a friend that embeds a VISIBLE copyright on every photo he posts.
He also puts info "inside" the jpeg.

get that.
I have a friend that has constant issues with people swiping her

Not that what eHow did was correct, but is there anywhere on
garagewoodworks that says anything about copyright? I looked all around
and couldn't find any copyright information.

If it is copied into the work which is submitted to the teacher _only_,
then yes, it clearly comes under the scholarly research fork of 'fair use'.

If it is 'published' to the world-at-large, the situation is _very_
different.

I used to make web searches for the (trademarked) name of a company I
did sys admin work for, and would contact the parties using the name
'without license' (It was a _good_ name for a particular line of work
and lots of people came up with it 'independently', *including* several
Universities.) Most of the time, my phone call was enough -- especially
with the Universities -- The 'unreasonable' ones were forwarded to the
corporation counsel, who (most of the time) sent a cease-and-decease
demand that was complied with. Occasionally, counsel decided that the
other party was in a line of work that was 'enough different' from what
the company did that it was arguably _not_ infringement, and ti was let
slide. One party _did_ get *really* testy about it -- at least until
they consulted _their_ legal counsel -- whereupon their tune changed,
shall we say, radically. <grin>

The point remains, you've got to be prepared to take action to defend your
rights, or the 'others' _will_ trample you.

I suspect that he believed the attribution (the garagewoodworks URL)
that appeared when one clicked on the image was sufficient.
