Going by "desires" would be mob rule. A lynching is pure democracy in
action.
A judge in the USA is required to follow the Constitution and screw
what 50 million people want.
That being said, it is also obvious that many judges have in the last
few years decided that they can "interpret" the Constitution to mean
whatever they damned well WANT it to mean.
Yep, this "society ruled by laws" business sure is a royal pain in the
posterior.
